What data is collected?

As a User, when you browse the Site and/or use the services offered on the Site, Pop Chignon may collect the following personal data about you:

  • Identification data: name, first name, copies of identity card and/or passport, IP address, interests and/or actual or presumed personal needs, data relating to the device used
  • Contact data: email address, postal address (delivery and billing), phone number
  • Payment and billing data: payment method used, bank details, billing information
  • Data relating to interactions between the User and Pop Chignon: content of the contact message sent to Pop Chignon via the Site
  • Data relating to the monitoring of the commercial relationship and order management: requests for information between the User and Pop Chignon, history of exchanges with Pop Chignon's services, order details and tracking, subscription to Pop Chignon newsletters, validation or abandonment of the shopping cart, etc.

Pop Chignon collects and processes your personal data for the following explicit, legitimate and determined purposes:

Pop Chignon collects and processes your personal data, according to the envisaged processing, on the following basis: 

  • Management of the proper functioning and continuous improvement of the Site: legitimate interest;
  • Management and tracking of orders: performance of the contract concluded between the User and Pop Chignon;
  • Management and tracking of Pop Chignon newsletter subscriptions: User consent;
  • Sending commercial prospecting and targeted advertising: User consent;

Pop Chignon informs you that while using the services offered on the Site, you may be required to fill out various forms and provide different personal data about you in order to benefit from certain services offered by Pop Chignon.

When necessary under the GDPR and the Data Protection Act, Pop Chignon undertakes to obtain your consent and/or allow you to object to the use of your personal data for certain purposes.

Pop Chignon may also send commercial solicitations to Users who have accepted them. Finally, Pop Chignon may send SMS messages (SMSBump service) to Users who decide not to validate their shopping cart, and only after prior collection of their consent. How long is this data kept?

Personal data is kept in accordance with legal provisions for a period not exceeding that necessary for the purposes for which it is collected and processed by Pop Chignon.

However, the processing of personal data is possible for the proof of a right or a contract. This personal data may also be kept by Pop Chignon to comply with a legal obligation, or be kept in files in accordance with applicable regulations and laws.

By exception, the personal data necessary for the creation and management of the User account is deleted by Pop Chignon when the User deletes their account.

The personal data processed as part of the management of the commercial relationship between Pop Chignon and you, as a purchaser of a Pop Chignon product, cannot be kept beyond the period strictly necessary for the management of this commercial relationship, plus the applicable legal statute of limitations.

The personal data processed as part of the management and tracking of Pop Chignon newsletter subscriptions as well as in the context of commercial prospecting and targeted advertising are kept for three (3) years from the end of the commercial relationship if you are engaged in a contractual relationship with Pop Chignon, and three (3) years from the last contact with you if you are not engaged in a commercial relationship with Pop Chignon.

The personal data processed as part of the management and tracking of your requests made on the Site or via the address contact@popchignon.com are kept for three (3) years from the end of the commercial relationship if you are engaged in a contractual relationship with Pop Chignon, and three (3) years from the last contact with you if you are not engaged in a commercial relationship with Pop Chignon.

For the management of your requests regarding your personal data, your personal data is kept for the calendar year of the request plus five (5) years.

However, Pop Chignon reminds you that personal data allowing the proof of a right or a contract, or kept pursuant to compliance with a legal obligation, may be subject to an intermediate archiving policy for a period not exceeding the period necessary for the purposes for which they are kept, in accordance with the provisions in force.

Is the data transmitted to third parties ?

Only the persons authorized by Pop Chignon mentioned below will have access to your Personal Data:

  • Authorized personnel from Pop Chignon's various departments (authorized personnel from the communication, administrative, logistics, and IT departments, responsible for customer relationship management and control); 
  • Pop Chignon's Subcontractors acting on behalf of and for the account of Pop Chignon, including the Site's host, the service provider in charge of processing Pop Chignon's customer support service, the service provider in charge of sending newsletters and commercial prospecting and advertising emails, the service provider in charge of sending commercial prospecting SMS messages, the service provider in charge of processing payments, tracking orders, and invoicing; 
  • Relevant jurisdictions, mediators, lawyers, bailiffs, etc. 
  • Third-party social networks. Pop Chignon informs the User that the Site may use social plugins provided and operated by third-party companies, such as the Facebook, Instagram, Pinterest, or YouTube button. By clicking on these buttons, you may send these third parties the information you view on a page of the Site. However, Pop Chignon informs the User that if they are not logged into the account they opened with the third party concerned, the latter will not be able to know the User's identity. On the other hand, if the User logs into the account they opened with the third party concerned, then the latter will be able to link the information or actions related to the User's interactions with the Site to the account they opened with that third party. Pop Chignon refers the User to consult the privacy policies of each of the third parties concerned to learn about their practices regarding the processing of Personal Data.

As part of its customer support service, Pop Chignon uses a service provider. 

This is the company Stripe Payments Europe Ltd., whose registered office is block 4, Harcourt Center, Harcourt Road, Dublin 2, Ireland.

This provider processes Personal Data on behalf of Pop Chignon to carry out the payment and invoicing operations for orders placed on the Site.

In this capacity, Pop Chignon informs Users that identification, contact, and payment data are directly transmitted to Stripe Payments Europe Ltd. from the Users' browser at the time of placing the order. Personal Data is used exclusively by Stripe Payments Europe Ltd. for the execution and processing of payments and is transmitted securely via the "SSL" encryption method. Stripe Payments Europe Ltd. is PCI DSS certified.

 Order tracking and invoicing

As part of its order tracking and invoicing service, Pop Chignon uses the Shopify system.

This is the company Shopify Inc., whose registered office is 150 Elgin Street, Suite 800 Ottawa, ON K2P 1L4 Canada.

This provider processes order tracking and User invoicing on behalf of Pop Chignon.

In this capacity, Pop Chignon informs its Users that by placing an order on the Site, Shopify Inc. may collect and process the following Personal Data:

  • User identification data; 
  • Billing data.

Customer support

As part of its customer support service, Pop Chignon uses a provider's ticketing system for the technical and qualitative monitoring of customer satisfaction, and its continuous improvement, for the benefit of Users.

Sending newsletters, commercial prospecting, and advertising

As part of its newsletter, commercial prospecting email, and advertising services, Pop Chignon uses a provider's email marketing platform.

Pop Chignon reminds the User that these transfers of Personal Data are necessary for the following processing:

  • Management and tracking of Pop Chignon newsletter subscriptions; 
  • Sending commercial prospecting and targeted advertising.

This processing is based on the User's consent. Thus, if the User no longer wishes Pop Chignon to carry out such transfers, they can withdraw their consent at any time by clicking on the unsubscribe link present in each email containing Pop Chignon newsletters, commercial offers, or advertisements, or by informing Pop Chignon by email at contact@popchignon.com (see Article 8 of the Privacy Policy).

 Sending commercial prospecting SMS messages

As part of its commercial prospecting SMS services when the Site User decides not to confirm their shopping cart, Pop Chignon uses a provider's services.

Pop Chignon reminds the User that these transfers of Personal Data are necessary for the following processing:

  • Sending commercial prospecting.

Google Tag Manager

Pop Chignon informs its Users that it uses the Google Tag Manager tool. This tool allows Pop Chignon to manage the tags of its Site (Site code). These facilitate the management and development of the products and services offered on the Site, and reduce the Site's loading time.

Google Tag Manager only implements the Site code. Google Tag Manager does not create cookies and does not collect any Personal Data. The tool only integrates the Site code, and facilitates the modulation of the code without accessing the Personal Data processed by the code.

However, Pop Chignon wishes to inform its Users of the existence of any tag integrated in this Privacy Policy.

What are your rights as Users?

As a User, you benefit from the right of access, rectification, portability, limitation, opposition, and erasure of your Personal Data.

Pop Chignon also informs you that you can set directives regarding the retention, erasure, and communication of your Personal Data after your death.

In addition, regarding the processing requiring the collection of your consent, Pop Chignon informs you that you can revoke your consent to the processing and use of the data you had previously consented to, with effect for the future, at any time.

Pop Chignon informs you that if you wish to exercise your rights, you must indicate to Pop Chignon in your request your contact details (name, first name, address, and a copy of a signed ID card) as well as a legitimate reason when required by law (notably in case of opposition to processing).

When you provide a copy of an ID card to prove your identity, Pop Chignon keeps it for the calendar year of the request plus five (5) years, notably when this communication is carried out as part of the exercise of a right of opposition.

 

Pop Chignon informs you that its products and services available on the Site are intended for adults and minors over 16 years old only. In this capacity, Pop Chignon does not process Personal Data of minors under 16 years old except with the prior consent of their legal representatives. 

Pop Chignon reminds any internet user visiting its Site that if they are under 16 years old, they must not send it information about themselves, notably Personal Data, except with the prior consent of their legal representatives. 

Does the Site use cookies?

Pop Chignon informs its Users that Cookies consist of a sequence of information, a small text file, installed by their browser on the hard drive of their terminal during their visit to a website. 

Thus, Users' navigation on the Site may result in the placement of "Cookies" on their terminal, if they continue their navigation on the Site without changing their browser settings.

Pop Chignon uses several types of Cookies.

What security measures are in place?

Pop Chignon takes all useful precautions, as well as appropriate technical and organizational measures, regularly updated according to technological progress, to preserve the security of Users' Personal Data and, notably, prevent them from being distorted, damaged, or accessed by unauthorized third parties.

In this capacity, Pop Chignon notably uses firewalls and Personal Data encryption systems. Pop Chignon's buildings are subject to physical access controls. Only Pop Chignon employees who need access to Personal Data due to the functions they perform and in order to carry out their activities are authorized to have access to Personal Data.

All Personal Data transmitted by Users, including information related to the payment of orders placed on the Site, is transmitted via the secure SSL (Secure Socket Layer) standard. 

What about links to third-party websites?

The Site may offer Users links to third-party websites such as Facebook, Instagram, Pinterest, or YouTube. 

Pop Chignon informs Users that it exercises no control over the content of third-party websites or the practices of these third parties regarding the protection of Personal Data they may collect.

Consequently, Pop Chignon declines all responsibility regarding the processing by these third parties of Users' Personal Data.

What is the applicable law?

This Privacy Policy is subject to French law. In case of a dispute and in the event that an amicable agreement cannot be reached, the competent courts will be the French courts.
